1. Agreement
These terms are an agreement between you and Lystiva ("Lystiva", "we", "us") for use of the Lystiva website, web application, and related services. By creating an account or using the service, you agree to these terms and to the Privacy Policy. If you use Lystiva for a business, you confirm that you can accept these terms on its behalf.
You must be at least 18 years old, or the age of legal majority where you live, to create an account.
2. What Lystiva is
Lystiva is a product content workspace. A seller starts with a Source for a physical item or digital artwork, reviews its facts and photos, and can then create product images, listing copy, downloadable exports, and, where connected, listings in a WooCommerce or Etsy store.
Lystiva supports seller judgment. It does not certify an image, listing claim, marketplace policy, product safety claim, or commercial result.
3. Accounts and workspaces
You can sign up with an email address and password or continue with Google. Email verification is required before the account becomes active. Keep your password, verification links, and sessions private, and tell us at support@lystiva.com if you believe your account is compromised.
A workspace is the boundary for Sources, Studio work, assets, listings, exports, connected stores, and client review links. You are responsible for activity in your account and for anyone you share access or review links with.
Do not create duplicate accounts or manipulate account state to bypass credit, rate, workspace, provider, or marketplace limits.
4. Your content and permissions
You keep the rights you already have in the product photos, artwork, text, trademarks, logos, model references, shop material, and other content you submit. You must have the rights, permissions, and consents needed for Lystiva to process that content and for you to use the resulting work.
When you submit content, you give Lystiva the limited, non-exclusive permission needed to store it, make working copies, analyze it, transform it, send the relevant request to a service provider, and display it inside your workspace and the review links you create. This permission exists only to operate the service you request; it does not transfer ownership of your content to Lystiva.
Do not submit another person's private material, a person's likeness, or a protected work unless you are authorized to use it for the requested purpose. Person references and similar identity-sensitive inputs require additional consent in the product.
Subject to these terms and your rights in the inputs, you may use the images and copy you generate with Lystiva for your own commercial purposes. Generated output may be similar to output created for others, and we do not promise that it is unique or protectable.
5. Sources, AI output, and review
A Source is the factual root for downstream work. Lystiva may propose facts, questions, plans, prompts, or copy, but facts you confirm or correct take priority and unknown facts remain unknown.
Generated images, plans, listing copy, and other outputs are drafts for your review. They may be inaccurate, incomplete, visually inconsistent, similar to other work, unsuitable for a destination, or unable to support a product claim. Review dimensions, materials, colors, included items, personalization, pricing, shipping, safety, certification, origin, and every other important claim before you use or publish an output.
You are responsible for the content you export, publish, advertise, or otherwise make available. Lystiva does not promise that an output is eligible for a marketplace, complies with a platform's rules, or will produce sales, traffic, ranking, or other business results.
6. Studio and credits
The Studio offers seven Source-based workflows: Lifestyle, Re-shoot, Listing Graphics, Products & People, Mockups, Social & Ads, and Campaigns & Storefront. Re-shoot re-photographs one accepted product photo with the camera angle and product pose locked and rebuilds only the lighting, backdrop, and surface; it is not a retouching editor and its setup diagram is not a live preview.
A single generated image uses one credit. A 2×2 Economy grid of four images uses two credits. Source analysis, planning, review, listing copy, and exports do not use credits, but rate and fair-use limits apply. Images created with free welcome credits on the free plan carry a Lystiva watermark.
Credits are reserved before an image request and are used only when the resulting image is delivered to your workspace. If a request fails, the reserved credits are released. If the image provider does not return a definite result within about three minutes, we release the reservation and you are not charged for that request, even if a result arrives later. A successfully generated image is not refunded because you prefer a different creative result; you can review it and generate again.
7. Plans, payments, and refunds
Paid plans and top-up packs are sold through Creem, which acts as our Merchant of Record and processes payment, tax, invoices, and refunds. Prices and credit amounts are shown on the pricing page at the time of purchase. Subscriptions renew automatically each month or year until cancelled.
You can cancel at any time from Billing. Cancellation takes effect at the end of the current billing period, and you keep access to that period's credits until they expire. Upgrades take effect immediately with a prorated charge and credit difference. Downgrades take effect at the next billing period.
14-day refund: within 14 days of a payment, you can request a full refund for a subscription or top-up order if none of its credits have been used, or a refund of the unused portion if some have been used. Email support@lystiva.com from your account email address. Creem issues approved refunds to the original payment method. After 14 days, payments are non-refundable except where the law requires otherwise. A refund removes the unused credits from that order.
Credits are usage units, not money. They expire as described on the pricing page: monthly plan credits at the end of their credit month, top-up credits 12 months after purchase, and welcome credits 30 days after they are granted. Credits cannot be transferred or exchanged for cash.
If a payment is reversed through a chargeback, the remaining credits from that payment are removed and credits already used become a balance that must be repaid before new paid image generation is available. Cancellation, refunds, or chargebacks do not delete images or exports you have already created.
8. Exports and connected stores
A Listing Intent records an explicit destination and package decision without changing the Source. Preparing or downloading an export does not publish it anywhere; you choose what to upload.
If you connect a WooCommerce store or an Etsy shop, you authorize Lystiva to read your catalogue and to create or update listings when you explicitly review and send a change. New products are created as drafts, and publishing is a separate action you take. Imported products become unconfirmed Source proposals that you review; they are not accepted as facts automatically. You can disconnect a store at any time; to fully revoke access, also remove the authorization in your store settings.
Your use of a connected store or marketplace is also governed by that platform's own terms. You remain responsible for marketplace rules, shop settings, listing accuracy, taxes, shipping, customer obligations, and intellectual-property rights. Lystiva does not process orders, payments, fulfilment, or inventory for your store.
9. Client review links
You can share selected images with a client or collaborator through an expiring private review link. Anyone with the link can view those images, save them, and leave feedback until the link expires or you revoke it. Share links only with people you trust. Reviewer names are not verified, and reviewer approval is feedback only; you decide what to use.
10. Acceptable use
You may use Lystiva only for lawful product-content and commerce work you are authorized to perform. Do not use it to infringe rights, create deceptive or fabricated product claims, impersonate a person or business, create sexual content involving minors or non-consensual intimate imagery, expose private information, distribute malware, scrape third-party services without permission, evade provider or marketplace restrictions, attack or overload the service, or access another workspace.
Lystiva must not be used to generate sexual, sexually suggestive, adult, pornographic, nude, fetish, or otherwise NSFW content of any kind, including content involving adults, real people, or fictional characters. This prohibition applies to every Studio output, prompt, reference image, Model, Look, Scene, and export. We may block such requests, remove the resulting content, and suspend or terminate accounts that attempt to create it.
Do not rely on a generated image or text as evidence of a fact you have not verified. Do not use Lystiva to create regulated, safety-critical, medical, financial, or legal claims without the separate review those claims require.
11. Service changes, suspension, and termination
Lystiva is an evolving product. We may change, add, limit, or retire features, outputs, destinations, and pricing. We will give reasonable notice of material changes to paid plans, and price changes apply from your next billing period.
We may restrict or suspend access when necessary to protect users, providers, the service, or the public; to investigate abuse or security issues; to comply with law; or to enforce these terms. Where reasonable, we will tell you why.
You can stop using Lystiva at any time. To close your account and delete your data, cancel any active subscription and email support@lystiva.com from your account email address. Some billing, security, and audit records may be retained as described in the Privacy Policy.
12. Disclaimers and limitation of liability
To the extent permitted by law, Lystiva is provided as is and as available, without warranties that generated content will be accurate, unique, uninterrupted, secure, marketplace-compliant, or commercially successful. You make the final decision about what to export, publish, or rely on.
To the extent permitted by law, Lystiva is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid Lystiva in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law or your statutory rights as a consumer.
Nothing in Lystiva replaces legal, tax, safety, intellectual-property, or marketplace advice.
13. Changes and contact
We may update these terms. The effective date at the top of this page shows when they last changed. If a change is material, we will notify account holders by email or in the product before it takes effect. Continuing to use Lystiva after that date means you accept the updated terms.
